DENVER -- A unarmed homeless man is suing the Denver Police Department and the city claiming an officer used excessive force when he fired a Taser at him in 2016.

The lawsuit also claims that officer tried to cover it up in his police report.

It started when Officer Dulayev answered a call about two homeless men fighting at 1950 North Clarkson Street.

Bodycam video from our the Denver Post shows Officer Greg Dulayev approaching Greg Heard, 53, who was in a bush at the time. Heard comes out from the bushes, then is shot with a Taser and tackled. A DPD investigation determined Dulayev did not break policy or his training.

In a statement sent to Denver7 Thursday night, the Denver Police Department asked the public to wait until the lawsuit has been resolved to jump into any conclusions.

“We respect the judicial process and we ask the public to reserve judgment until the conclusion of the lawsuit.”
